***ADVOCACY UPDATE***

Auto No Fault Reform remains a high priority for the House Republican Caucus as it is included again in the caucus action plan  –  2017-2018 House Republican Action Plan, “The Best Way Forward, Common-sense Leadership for the People of Michigan.” (see attached and on page 3). No specific recommendations  are spelled out to get to affordable rates, but when messaging it that way, it tends to narrow certain strategies and opportunities,  as no “tinkering” with the system gets you significant premium reduction.  This was somewhat confirmed by a meeting I had last Friday afternoon with the Speaker’s Senior Policy Advisor, and both Legislative and Deputy Legislative Directors. They did not think anything was going to happen in the very near future but did indicate that House Insurance Committee Chair Theis was being methodical in her approach to various reforms.  She  personally remains convinced at this time to address the subject matter more incrementally because of the complexity of the issue and perhaps due to  the possible undesirous position of pressuring  insurance companies to actually reduce their premiums.

Last week, we also met with House Democratic Leader Sam Singh who will push for a comprehensive  package and also thought the threat of D- Insurance promoted by Mayor Duggan would not ultimately get thru the House. Leader Singh’s meeting with Mayor Duggan was not any more promising than when CPAN met with the Mayor and his staff two years ago. D- Insurance, or perhaps more likely a statewide PIP proposal might become more attractive to some but with the uncertainty of the ACA, the promise that folks would still   have health care coverage thru the ACA or thru Healthy Michigan (Medicaid Expansion) weakens the proposal. However,  last night, without giving specifics, the Mayor did end his State of the City Address with the need for ANF reform.  While saying he wants to cut costs, he also alluded to the State of Ohio which has a tort system. This is not the first time the Mayor has mentioned the possibility of supporting efforts to go back to tort where you will need to sue the negligent driver for medical expenses, etc.  Mark Bernstein’s presence at the event was not by accident.

This past Monday, I met with Rep. Tim Greimel who has now been appointed the House Insurance Committee Minority Vice Chair.  Rep. Greimel is open to our reform agenda and also believes that a bigger more comprehensive approach is the only way you will get the kind of issues address for patients, providers and drivers.  We also discussed a weekly meeting with his committee members and policy staff, or as often as needed, to keep in concert with the various issues being discussed.

Meetings are now being requested with Speaker Leonard and Committee Chair Theis to discuss the reform agenda.  This morning, Rep. Theis indicated that she was still working thru the various issues of insurance which also includes non ANF matters. We will also share our agenda in a timely fashion with our supportive lawmakers (CPAN Legislative Champions) and new members that have expressed a willingness for balanced reform, prior to pushing it out to a broader audience.

While CPAN has finished its scheduled morning briefings with House Republican Freshman, we are providing three ring binders with information coming into each legislative office on a weekly basis. We again sent out the information on our Transparency Case against the MCCA as the Insurance Institute of MI was scheduling a MCCA 101 Briefing for new members.

On March 2, George Sinas  and I will be meeting with Chair Lana Theis along with the Michigan Auto Insurance Placement Facility to discuss the ACP claims process. This remains a top priority for Chairperson Theis and likely the first ANF issue she will tackle later this winter/spring.

Yesterday, I was in a meeting with U.S. Senator Gary Peters along with a number of insurance interests. The topic of autonomous vehicles and how the Feds and state’s  will address its impact to accidents, injuries, liability and equally significant job displacement or realignment was a fascinating discussion.  Senator Peters stated the obvious,  that technology is well ahead of  state and federal regulations, which will take a long time to catch up to the emerging technology advances.

Andrew Harvey has taught at Oxford University, Cornell University, Hobart and William Smith Colleges, The California Institute of Integral Studies, and the University of Creation Spirituality as well as the at various spiritual centers throughout the United States. He was the subject of the 1993 BBC film documentary The Making of a Modern Mystic and appears also in Rumi Turning Ecstatic and The Consciousness of the Christ: Reclaiming Jesus for A New Humanity. He has also worked with the great Iranian Sufi dancer, Banfsheh Sayyad, in producing a film, In the Fire of Grace, which marries Sufi inspired dances to the stages of Rumi’s understanding of the path of Divine love. This 2011 film has had premiers in New York City, Los Angeles, Chicago and Paris, to great acclaim.

UPDATE: Despite a strong push by the Senate Majority Leader, a full court press by the two insurance coalitions (Insurance Institute of MI and Michigan Insurance Coalition) and their individual members, and the Michigan Health and Hospital Association and their member health care systems, they could NOT muster up enough support in the House during the final hours to pass auto no fault changes. In fact, in the end, their whip count was so bad that they were finally convinced it would be a mistake to force a vote on the measure and asked the Speaker to remove it from the final priority list.

CPAN (minus MHA) with its collective advocacy were successful to stop this last minute push to cap benefits on those in the assigned claims program, limit family provided attendant care and the establishment of an insurance fraud authority.

Thanks to all of you who responded with timely emails, phone calls and lobbying at the Capitol Building. Without you, we would not have prevailed. The Legislature has now adjourned for the year and no further legislative business will take place this session.

SAMPLE LETTER

I am writing to urge you to vote no on the proposed last-minute draconian changes to Michigan’s no-fault auto insurance system. The bill that was just introduced will significantly harm Michigan’s most seriously injured accident victims and only benefit insurance companies.
Here’s why this bill is wrong for Michigan:

A $400,000 cap on claims handled by the Michigan Assigned Claims Plan and certain injury claims resulting from out-of-state accidents harms the most vulnerable and seriously injured accident survivors. Severe auto injuries can cost hundreds of thousands in the first week alone. And just because the injury benefit is capped doesn’t mean the need for care will go away. Eventually, our most seriously injured people will end up relying on government-funded programs like Medicaid. Previous studies have shown that capping injury benefits will shift millions of dollars in costs from insurance providers onto the backs of taxpayers.

The bill makes draconian cuts to family provided attendant care that will harm Michigan’s most seriously injured accident victims. The family-provided attendant model is cost-effective and allows injured person to receive care from those who know the person the best and care about the person the most. he hourly rate cap will cause many families to hire commercial nursing care, which is significantly more expensive for the no-fault insurers than paying family or household members to provide noncommercial care.

In addition, catastrophically injured people often require 24 hour attendant care and sometimes a cumulative total amount of daily care beyond 24 hours. Under this bill, care will be capped at 56 hours PER WEEK! The only way these injured people can receive payment for attendant care is by going through the undefined and unexplained “medical review” process, which creates enormous uncertainty regarding whether they will be able to receive the amount of care that they require.

This bill creates a biased and weak Fraud Authority. While reducing fraud is an important part of fixing Michigan’s no-fault system, we need a balanced fraud authority. Insurance companies regularly and knowingly deny legitimate insurance claims. This is equally fraudulent activity. Michigan needs a balanced fraud authority with representation from the health care provider community. In addition, the Fraud Authority proposed in the bill has no actual power. We need a Fraud Authority to conduct true criminal investigations regarding actual acts of fraud.

This bill puts insurance company profits over actual people. Nothing in this bill guarantees reduced rates for drivers. These changes are only benefitting auto insurance companies’ bottom lines at the expense of accident survivors and health care providers.
